According to the Department of Labor (DOL), 11 million employees will be impacted by the new Overtime Rule. The new rule will have a significant impact on employees and employers across every industry and sector. Employers will need to analyze employee classification and make adjustments to salaries.

Salary Level will increase for exempt employees from $455/week ($23,660 annually) to $913/week ($47,476  annually).

Automatic salary threshold will increase every three (3) years to maintain level at 40th percentile in lowest-wage region.

Duties test for exempt status remains unchanged.

Highly compensated employee’s exemption will increase from $100,000 to $134,004 per year. The threshold is set at the 90th percentile of full-time salaried workers nationally.
